Product Review, Liability Waiver
1. In consideration for receiving permission to participate in New Mommy Media, LLC product evaluation I hereby release, waive, discharge and covenant not to sue New Mommy Media, LLC, their officers, agents, servants, or employees (hereinafter referred to as releasees) from any and all liability, claims, demands, actions and causes of action whatsoever arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or any of the property belonging to me, whether caused by the negligence of the releasees, or otherwise, while participating in such activity, or while in, on or upon the premises where the activity is being conducted.
2. I am fully aware of the risks involved and hazards connected with product evaluation, including but not limited to injury, and I hereby elect to voluntarily participate in said activity with full knowledge that said activity may be hazardous to me and my property. I voluntarily assume full responsibility for any risks of loss, property damage or personal injury, including death, that may be sustained by me, or any loss or damage to property owned by me, as a result of being engaged in such an activity, whether caused by the negligence of releasees or otherwise.
3. I further hereby agree to indemnify and hold harmless the releasees from any loss, liability, damage or costs, including court costs and attorney fees, that they may incur due to my participation in said activity, whether caused by negligence of releasees or otherwise.
4. I understand that New Mommy Media, LLC does not maintain any insurance policy covering any circumstance arising from my participation in this event or any activity associated with or facilitating that participation. As such, I am aware that I should review my personal insurance portfolio.
5. It is my express intent that this Waiver of Liability and Hold Harmless Agreement shall bind the members of my family and spouse, if I am alive, and my heirs, assigns and personal representative, if I am deceased, and shall be deemed as a release, waiver, discharge and covenant not to sue the above-named releasees. I hereby further agree that this Waiver of Liability and Hold Harmless Agreement shall be construed in accordance with the laws of California.
6. In signing this release, I acknowledge and represent that I have read the foregoing Waiver of Liability and Hold Harmless Agreement, understand it and agree to it voluntarily as my own free act and deed; no oral representations, statements, or inducements, apart from the foregoing written agreement, have been made; I am at least eighteen (18) years of age and fully competent; and I execute this release for full, adequate and complete consideration fully intending to be bound by same.
I agree to this Waiver and Agreement.
New Mommy Media, Blogging Agreement
The following are the terms and conditions governing article submissions to the websites owned by New Mommy Media including Preggie Pals, Parent Savers and The Boob Group (hereinafter “New Mommy Media"). We ask that you (hereinafter "Blogger") read the terms of the Agreement (hereinafter "Agreement") with New Mommy Media carefully.
General
By submitting your article, commentary, report, recommendation, review, analysis or other content ("Content") to New Mommy Media, Blogger agrees to these terms and conditions. New Mommy Media reserves the right, in its discretion, to change or modify all or any part of this agreement at any time, effective immediately upon publishing such changes or modifications.
The Content
Blogger will enter blog posts directly to the show website through Blogger’s personal user login. When submitting any content to the Site, Blogger represents that Blogger has full rights to send us the content and that sending us the content for publication on New Mommy Media websites will not violate or infringe the rights of any third person or party, including but not limited to, rights in copyrights, patents, trademarks, service marks, trade secrets or other proprietary rights. New Mommy Media reserves the right to edit the content and make changes at its own discretion. If posts require a significant amount of changes, New Mommy Media will ask Blogger to make the revisions and resubmit the article. New Mommy Media does not have the exclusive rights to this content and Blogger may re-purpose the Content elsewhere.
Requirements For Occasional Submissions (Guest Blogger)
One time submission from Blogger is subject to all terms and agreement of Agreement with the exception the terms and agreements for continuous submissions. Blogger may submit Content at any time within the calendar year.
Requirements For Continuous Submissions
(Featured Blogger)
Continuous submission from Blogger is subject to all terms and agreement of Agreement with the exception the terms and agreements for one time submissions. Blogger must commit to submitting Content at least once a calendar month. Content must be submitted to New Mommy Media by the first day of the calendar month. Blogger must contact New Mommy Media if Blogger can no longer meet this requirement prior to submission deadline for the calendar month.
Payment and Promotion
Blogger understands New Mommy Media is not obligated to compensate you, and you are entering this agreement without the expectation of any payment. New Mommy Media agrees to promote each blog post and product review via its websites and social networking platforms. If Blogger is writing product reviews, Blogger can keep the product after review is written and complete, unless otherwise noted. Blogger is expected to promote any articles submitted to New Mommy Media through Blogger’s website, blog and social media. Blogger can also create a profile through the New Mommy Media site that will appear at the bottom of each article, to help promote Blogger to visitors.
Termination Of Service
New Mommy Media reserves the right, in its sole discretion, to restrict, suspend, or terminate New Mommy Media websites at any time, for any reason without prior notice or liability. New Mommy Media may change, suspend, or discontinue all or any aspect of New Mommy Media at any time.
Miscellaneous
Blogger agrees that this is the entire Agreement between Blogger and New Mommy Media related to the Content and that this Agreement supersedes all previous agreements and understandings related to the Content. Any disputes related to this Agreement shall be governed by the laws of the United States of America and Author consents to the jurisdiction of the courts of the same.
